These Terms of Service (the "Terms") govern your use of 听记 (Tingji), 听记电脑版 (Tingji for Windows and Mac) and 阅记 (Yueji), together "the Service". By creating a 听记账号 (Tingji account) or using the Service you agree to these Terms.
1. Who we are
The Service is operated by Kaixin Zhang, a sole trader based in Hamilton, New Zealand, trading as Tingji(听记). Contact: tingji.kaixin@gmail.com.
2. The Service
The Service helps students who study in English read and listen in Chinese. It has three parts that share one Tingji account:
- 听记 (Tingji) on the phone: records a class, shows English captions with Chinese under each line, and turns the recording into notes after class.
- 听记电脑版 (Tingji for Windows and Mac): live bilingual captions for classes and online lectures on a computer, saved to the same account.
- 阅记 (Yueji), a browser extension for Chrome and Edge: shows Chinese next to the original text of web pages and course materials, and answers questions about them.
Captions, translations, notes and answers are produced by automated speech recognition and AI. They may contain mistakes and are provided for reference only. Check anything that matters against the original.
3. Your account
- One account is for one person. Do not share your sign-in or let others use your account.
- You are responsible for what happens under your account and for keeping your sign-in details safe.
- You may delete your account at any time from the Service's settings or by emailing us; see the Privacy Policy for what is deleted.
4. Plans, trials and fair use
- Yueji can be used on its own. It has a free plan with daily and monthly limits, and paid plans.
- The full plan (全套) covers all three parts. It includes a monthly allowance of live caption hours shared by the phone and the computer, and unlimited web page and course material translation within fair use.
- Monthly plans renew automatically each month until you cancel. You can cancel at any time; the plan then stops at the end of the current period.
- Term plans (学期卡) are paid once, last four months and do not renew.
- Extra hours (加购时长) can be bought for the full plan when the monthly allowance is used up. They are only sold with the full plan.
- Upgrading from Yueji to the full plan costs the difference between the two plans for the remaining period.
- A free trial of the full plan lasts 3 days and includes 5 hours of live captions. One trial per person.
- Fair use: the Service is for one person's own study. We may slow down or limit use that is far beyond what one person would reasonably need, and we will tell you when we do.
5. Prices, payment and tax
Prices are shown on the pricing page and depend on the region you buy in. In New Zealand, Australia, the United Kingdom and Singapore the prices shown include tax; in the United States and Canada tax is added at checkout where it applies. Customers in regions not listed pay the United States price. The Service is not currently sold in the European Union.
Orders from customers outside New Zealand and Australia are processed by our online reseller Paddle.com, which is the Merchant of Record for those orders and handles their payment, taxes and refunds. Orders from customers in New Zealand and Australia are processed by Tingji directly through Stripe.
Refunds are handled under our Refund Policy.
6. Recording classes
The Service is for your own personal study. Recording a class may need the permission of your school and your teacher, and some places have laws about recording other people. It is your responsibility to check the rules that apply to you and to get any permission you need before you record.
7. What you may not do
- Resell, rent or share the Service or your account.
- Use the Service to translate in bulk for others, or to build a competing service.
- Reverse engineer, decompile or tamper with the apps, the extension or the servers, or try to get around the limits of your plan.
- Upload content you have no right to use, or use the Service in a way that breaks the law.
8. Your content and our rights
Your recordings, course materials, notes and words stay yours. You give us only the permission we need to run the Service for you: to store your content, process it with speech recognition and AI, and show it back to you on your devices. The Service itself, its software, design and name belong to us.
9. Suspension and termination
We may suspend or end your access if you break these Terms, if your payment fails, or if we have to stop the Service. If we end the Service for everyone, we will give notice and refund any prepaid period you have not used. You can stop using the Service at any time.
10. Liability
The Service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by mistakes in captions, translations, notes or answers. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits rights you have under the law that cannot be limited, including the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, and consumer protection laws in other regions.
11. Changes to these Terms
We may update these Terms. If a change matters to you, we will tell you in the Service or by email before it takes effect. Using the Service after the change means you accept the new Terms.
12. Law and language
These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction, without taking away protections you have under the consumer law of the place you live. These Terms are written in English and Chinese; if the two versions differ, the English version prevails.
